Zero tolerance for 4 or more nuisance abatement violations (Springfield)
§ 98.06. Chronic nuisances. Chronic nuisance property is property upon which two or more criminal activities have occurred during any 60-day period. The Chief of Police shall notify the owner and give them ten days to rectify the nuisance. If there are four or more violations within a 60 day period the case shall be sent directly to the corporation counsel who shall enter a temporary restraining order or a preliminary injunction to enjoin any defendant from maintaining such nuisance. The City shall request the Circuit Court to order the property be closed and secured against all use and occupancy for a period of not less than 30 days, but not more than 180, and a civil penalty in the amount of up to $100 per day, be paid to the City of Springfield, for each day the owner had actual knowledge that the property was a public nuisance property and permitted the property to remain a chronic nuisance property.
